You get a situation where employers can be really picky about who they employ, and they need some metrics to sort through the unmanageable pile of applications anyway, and despite the recession alot of their jobs are still fluff jobs so competence isn’t a big issue. But if they too openly reject applicants for being the wrong race, sex, or to some extent religion they get into legal trouble. If they hire someone with a conviction, who then commits another crime, they get into trouble. So as the labor force shrinks and people are excluded, people with convictions become one of the first groups to be excluded.
