NYT: "Court Orders Three H1-B Sites Disabled," Dec. 29, 2009 The routine intimidation of Indian tech workers has now been directed at American tech workers who wouldn't snitch on an Indian tech worker, threatening all Americans' free speech on the Internet.

New Jersey and Free Speech: "The action has labor rights activists, free speech activists, and even some beneficiaries of the H1-B visa program united in voicing opposition to the court decision," according to an editorial in the Oakland Journal, a local New Jersey paper.

This article is a must read for every player in September's discussions on comprehensive immigration reform.

Ovbery lays out the case: companies have been misusing immigration laws to outsource American jobs. Don't ask for whom comprehensive immigration reform is for -- it's clearly for us.

A provision of the H-1B and L-1 Visa Reform Act of 2009, intended to prevent companies from replacing American workers with H-1B visa holders, will make it more difficult for outsourcing vendors to place H-1B professionals at customer sites if the legislation is passed.

"While the fate of the legislation that would alter the administration and regulation of the H-1B visa program remains up in the air, one thing is clear: The bill contains an important provision, designed to prevent the displacement of American workers, that could put a serious wrinkle in the typical offshore outsourcing arrangement."

I don't think the proposed legislation really gets to the core problem -- companies are hiring from overseas because they are greedy and they make make more profits by paying lower wages and benefits to guest workers. If they can hire foreign workers, then they even have a motivation to lobby for less funding for American schools. We should take the employers at their word when they claim they can't find Americans to do the jobs. When the employer hires a guest worker because they can't find an American worker, they should be required to pay a fee equal to the wage differential + 5%. So, if they hire a guest worker for $80,000 in wages and benefits and the going rate for an American worker is $100,000, the the employer should be required to pay a fee of $25,000 per year for the privilege. That money can then be used to provide education in the scare specialty to American workers, so that trained American workers become available. Liz

I should have read the other comments a bit more thoroughly. 80,000K a year jobs are a near extinct event. Companies that outsource American jobs expect workers to meet or exceed those slave labor peanuts. The American worker either takes a substantial pay-cut or doesn't get the job. The carpetbagging companies doing this need a big ray of sunshine on their practices. Nothing worst than a bad reputation, real or perceived. The media could help us out with this method, IF they weren't already on the hush hush payout from these very un-American companies. They would sell more airtime and papers bringing to American TV than a Toyota car. The truth is, the US media is probably on the boards of these very companies. Taking their cut and looking the other way. .

It's not always as simple an analysis as overseas jobs results in job losses here. In my own self-employed business, I rely on inexpensive overseas help so I can be profitable. If i am profitable, I can hire more workers here. If I could not outsource, I would simply go out of business.
