NYT: "Court Orders Three H1-B Sites Disabled," Dec. 29, 2009 The routine intimidation of Indian tech workers has now been directed at American tech workers who wouldn't snitch on an Indian tech worker, threatening all Americans' free speech on the Internet.

New Jersey and Free Speech: "The action has labor rights activists, free speech activists, and even some beneficiaries of the H1-B visa program united in voicing opposition to the court decision," according to an editorial in the Oakland Journal, a local New Jersey paper.

Businessweek: "Jobs and Protectionism in the Stimulus Package," February 16, 2009 Critics of the H-1B program hailed the inclusion of the amendment as a victory. "The demand to reform corporate recruiting policies that ignore highly skilled local talent now moves center stage," says Donna Conroy, director of Brightfuturejobs.com, a lobbying group for visa reform.

Obama, H-1b and The Secret Tech Lobbyists Don't Want You to Know
 

Obama is ready to expand the H-1b employer program. But no nation can be strong when employers can legally ignore local talent.

The contrast of Senator Obama’s campaign call for expanding H-1b program just as layoffs increase dramatizes the need and opportunity for intensive lobbying by the high-tech community.

 

  You have the power to bust the myth that tech lobbyists don't want the Obama team to know: that employers can bypass qualified Americans via the H-1b employer-visa hiring program.

President-elect Obama can make headway on reclaiming the American Dream of Equal Employment Opportunity by supporting Durbin's H-1b & L-1 reform legislation (SB 1035).

Tech lobbyists spin myths to deflect the truth: that the H-1b and all other guest worker programs for top dollar, white-collar jobs allow employers to bypass the US workforce and even displace workers.

The Obama team should know that the  DOL's Strategic Plan, Fiscal Years 2006-2011 states: "...H-1B workers may be hired even when a qualified U.S. worker wants the job, and a U.S. worker can be displaced from the job in favor of the foreign worker."

Send them a message now demanding that the Obama administration push for passage of Senator Durbin's H-1b reform bill (SB 1035).  It will restore Equal Opportunity to citizens and green card holders by requiring employers to seek local talent for their US job openings before tethering foreign workers to their company.

It will also prevent Indian outsourcing labor contractors from displacing Americans who are currently in jobs with their tethered foreign workers.

Now is the time to make the Obama team understand that expanding this employer program will bypass thousands of qualified Americans and green card holders.

We are not alone in demanding that this be on Obama's radar.    Here's a snippet from an editorial by The Day, published in New London, CT:

"Congress must determine if qualified American workers are being bypassed .... Shouldn't U.S. citizens get first dibs at U.S. jobs? Critics argue that employers rarely, if ever, have to certify that no qualified U.S. workers are available before hiring from abroad under H-1B."

As the NYT reports, "The plunge is so severe that some executives are comparing it with the dot-com bust in 2000, when hundreds of companies disappeared and Silicon Valley lost nearly a fifth of its jobs."

Donna, this post is right on the money. Durbin's bill, SB 1035, needs to be passed into law. US employers are being handed visas to hire foreign workers. They would be able to hire US citizens and green card holders instead. Our government has provided this avenue to corporations, and they are using it to practice legal discrimination against Americans. It must change. US employers need to start hiring the US citizens who are qualified for the jobs and are available to accept the positions locally. Push for Equal Opportunity for US citizens and green card holders.

Obama supports raising the H-1B cap & did so in the U.S. Senate immigration bill in 2007. It would have increased the current 85,000 cap, which includes 20,000 visas set aside for graduates with advanced degrees. The Senate hard work, which died in the House, would have allowed increases of up to 180,000 H-1B visas, as well as additional visas for advanced-degree graduates. Obama also continues to support comprehensive immigration reform.
